Learning Platform Terms of Use

Please read these Terms of Use carefully before using the Short Course Learning Platform.

The University of Edinburgh ("the University", "we", "our") provides the Short Course Learning Platform (the "Learning Platform") to support the learning and teaching activities of the University.

These Terms of Use, together with the documents referred to within them ("Terms of Use"), set out the rules for use of the Learning Platform.

Terms

By using our Learning Platform, you accept and agree to our Terms of Use. If you do not agree to these Terms of Use, you must not use the Learning Platform.

  1. Other terms that may apply to you. These Terms of Use refer to the following additional terms, which also apply to your use of our Learning Platform:
    1. The Privacy Policy explains how we collect, use and store information about you.
    2. The Terms of Short Course Enrolment and Purchase agreed to when you registered for a short course that we deliver.
    3. The Learning Platform is governed by the University’s policies, regulations and guidance. These include without limitation the University’s Computing Acceptable Use Policy (opens in a new window) and the policies it refers to, and the University Web Accessibility Policy (opens in a new window).
  2. Changes to the Terms of Use. The University reserves the right to amend or replace these Terms of Use at any time. If we make any substantial changes, we will notify users by, for example, posting a prominent notice on the Learning Platform. Your continued use of the Learning Platform shall be deemed to constitute your agreement to any such changes. Please check this page regularly to ensure you understand the terms that apply to your use.
  3. Access to the Learning Platform. Access to the Learning Platform is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide, without notice where necessary.
    1. We do not guarantee that the Learning Platform, or any content on it, will always be available or be uninterrupted. From time to time, we may restrict access to the Learning Platform, in part or in whole, for example where we are conducting maintenance work.
    2. Although we make reasonable efforts to update the information on the Learning Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on the Learning Platform is accurate, complete or up-to-date.
    3. Although we make reasonable efforts to update the information on the Learning Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on the Learning Platform is accurate, complete or up-to-date. While we maintain a high level of information security on our Learning Platform, we do not guarantee that the Learning Platform will always be secure or free from bugs or computer viruses. You are responsible for correctly configuring your information technology, computer programs and platform to access the Learning Platform, and for keeping them up-to-date and secure. You should use your own virus protection software.
    4. Learning Platform course sites are only made available to the course staff and the learners enrolled on those courses. Access to course content is at the discretion of the course staff.
    5. You are responsible for ensuring that all persons who access our Learning Platform through your internet connection are aware of these terms of service and other applicable terms of service, and that they comply with them.
  4. You must keep your account details safe. If you choose, or you are provided with, a password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
    1. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use or the Catalogue and Enrolment Website Terms of Use.
    2. If you know or suspect that anyone, other than you, knows your password then you must promptly notify us at Enquiries.Shortcourses@ed.ac.uk.
  5. Learning Platform Permitted Uses. Whenever you use the Learning Platform, you must comply with the University’s Computing Acceptable Use Policy (opens in a new window) and in particular you must not:
    1. breach any applicable law or use the Learning Platform in a way that is unlawful or fraudulent or disrupts or restricts its use by other users;
    2. post or knowingly link to any content that is false, threatening, defamatory, discriminatory or obscene, is in contravention of the University’s Dignity and Respect Policy (opens in a new window), or that otherwise breaches or infringes the rights of any person;
    3. post any content that may damage the reputation of or goodwill towards the University;
    4. post any content for which you have not obtained all necessary licences and/or approvals and/or cleared copyright permissions;
    5. to send unsolicited or unauthorised advertising or promotional material; or
    6. post or transmit any material which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data);
  6. How you may use material on the site. We are the owner or the licensee of all intellectual property rights in our Learning Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved unless stated otherwise in writing.
    1. You may read, view, download and print one copy of the contents of any page(s) for personal use.
    2. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
    3. All copyright, trade mark and other proprietary notices contained in the materials must be retained.
    4. You must not use any part of the content on our Learning Platform for commercial purposes without obtaining our prior written consent.
    5. If you print off, copy, download, share or repost content in breach of these Terms of Use, your right to use this Learning Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made (except that you are permitted to print off a copy of these Terms of Use).
  7. Trademarks. The University of The University is the registered proprietor of UK trademark number UK00002101334 for The University of Edinburgh. The University’s name and sign may not be used without our prior written approval.
  8. Uploading content. We will consider any content you create using our site or upload to our site to be non-confidential and not protected by any trade mark, patent or copyright ("non-proprietary"), that is, in the public domain.
    1. You own your content, but you are required to grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, store and copy that content and to distribute and make it available to others. We will normally only use your content for the purposes of delivering, managing and quality assuring your course.
    2. Your course organisers may review your content uploads and posts on course discussion boards as part of the management, assessment and quality assurance of your course. The University does not otherwise routinely monitor content placed on the Learning Platform by users. Any views expressed within content on this Learning Platform are those of the contributor(s), and do not necessarily reflect the views of the University.
    3. Whenever you make use of a feature that allows you to create content directly on the Learning Platform, upload or share content to the Learning Platform, or to make contact with other users of the Learning Platform, you must comply with the standards set out in our Computing Acceptable Use Policy (opens in a new window) and the other University policies cited within it. You warrant that any such contribution complies with those standards, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
    4. We have the right to:
      1. review content where we receive notification that it contravenes these Terms of Use including without limitation the University’s Computing Acceptable Use Policy (opens in a new window);
      2. restrict access to, remove, or edit any content if, in our opinion, such material does not comply with the provisions set out in these Terms of Use. We will do this in accordance with our Virtual Learning Environments Notice and Takedown Policy (opens in a new window), except that all references to "the Service" in that Policy shall be taken to refer to the Short Course Learning Platform service governed by these Terms of Use;
      3. and/or disclose your identity to anyone who is claiming that any content posted or uploaded by you to the Learning Platform violates their intellectual property rights or their right to privacy.
    5. We shall fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of these Terms of Use.
  9. Third party websites. Where the Learning Platform contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources, and cannot accept any liability for such third party content.
  10. Limitation of the University's liability. To the extent permitted by law, the University:
    1. accepts no liability for any loss, destruction, corruption or damage arising under or in connection with use of, or inability to use the Learning Platform or use of or reliance on any content displayed on it; and
    2. excludes all conditions, warranties, representations or other terms which may apply to the Learning Platform or any content on it, whether express or implied.
    3. However, nothing in these Terms of Use excludes or limits our liability for death or personal injury arising from our negligence, fraud, or any other liability that cannot be excluded or limited by Scots law.
  11. Applicable Law. The Terms of Use, their subject matter and their formation, are governed by and construed in accordance with Scots law. We agree that any disputes will be subject to the jurisdiction of the Scottish courts.
